Diario Qué! invita formalmente a pintores nacionales e internacionales en su vertiente pop o street art a participar en el Premio de pintura Qué! Arte, cuyo fin es difundir, promocionar, o dar a conocer su arte.
Para participar, deberán cumplir con los requisitos establecidos en las bases y enviar un dossier a quearte@que.es que contenga sus datos de contacto, currículum, obras anteriores (si existieran), una descripción, fotografías y ficha técnica de la obra presentada y, de forma opcional, un video presentación.
El plazo de participación es del 7 de marzo de 2022 al 8 de mayo de 2022.
BASES DEL CONCURSO
Qué! es un periódico español generalista. Fue fundado en el año 2005. Actualmente pertenece al Grupo Merca2, del que también forman parte otros medios de comunicación online como Merca2.es, Moncloa.com y Cotilleo.es.
“El diario Qué! (de aquí en adelante el diario) con objetivo fundamental en la información y la actualidad, desarrolla el Premio de...Pintura “Qué Arte!” cuyo fin es apoyar y promocionar pintores jóvenes internacionales cuyo lenguaje sea próximo a la figuración, más concretamente su vertiente pop o street art que provoque una reflexión sobre la sociedad actual. Objetivos El objetivo de este premio es difundir, promocionar, o dar a conocer, el trabajo de pintores. El diario busca premiar trabajos con ambición artística y voluntad innovadora que reflejen el lenguaje personal de un autor. El Diario persigue ser mecenas de creadores tanto nacionales como internacionales cuyo lenguaje sea figurativo con contenido crítico capaz de producir pinturas que aspiren a crear memoria y reflexión.
Premio
La dotación del premio es de seis mil euros (6.000 euros) para la pintura ganadora más un reportaje que promocionaría al artista en el diario, con más de 3.000.000 de lectores mensuales. ato). El segundo y tercer clasificado tendrán dos reportajes sobre el autor y su obra en el Diario en los años sucesivos, 2022 y 2023.Con ello se busca el seguimiento de sus autores y la difusión de su obra.
El premio tendrá la retención del Impuesto sobre la Renta de las Personas Físicas (IRPF) correspondiente, de acuerdo con la legislación vigente en España, si corresponde.
Requisitos de participación
Podrá participar, de forma individual, cualquier artista, con licenciatura en Bellas Artes, Arquitectura o similar, mayor de 18 años en el momento del envío de la inscripción, y de cualquier nacionalidad. La técnica será pintura sobre cualquier soporte. El lenguaje será el figurativo próximo a las corrientes del pop art o street art con contenido crítico. La pintura presentada deberá ser original e inédita y no estar pendiente de votación o haber sido premiada en ningún otro certamen o concurso.
Cada participante podrá presentar una sola obra que conforma una única creación artística (de aquí en adelante, la obra). No se admitirán obras con contenidos violentos, sexistas, irreverentes, obscenos, xenófobos, anticonstitucionales o cualquier otro susceptible de atentar contra la dignidad de las personas o los Derechos Humanos.
No se descartarán obras que, aunque no se puedan clasificar en las categorías enumeradas, puedan ser aceptados por el comité de expertos siempre que cumplan con los objetivos y requisitos del concurso.
La Pintura premiada deberá ser:
Propiedad del participante, en todo momento, desde su creación hasta el final del periodo de licencia.
Una pieza original y única.
De creación actual (últimos cinco años).
No premiada anteriormente, y no estar pendiente de votación o haber sido premiada en ningún otro certamen o concurso.
Transportable e instalable.
Estas condiciones son esenciales para que las obras puedan ser admitidas como finalistas.
Cada autor podrá participar únicamente con una obra, de manera individual.
Sera descartada la participación en los siguientes casos:
Si el participante presenta la obra a otro concurso y obtiene un premio,
si la Obra deja de estar en su poder,
si, por cualquier razón que sea, pasa a ser titularidad de un tercero,
si la Obra se daña una vez se haya presentado, deberá notificarlo al diario con urgencia mediante correo electrónico para proceder a retirarla del certamen. Una vez la obra ha sido presentada al concurso, no podrá ser alterada en ningún sentido.
En caso de detectarse alguna vulneración de los requisitos de admisión, el participante podría quedar descalificado y su candidatura no ser contemplada.

Los participantes deberán mandar un dossier que reúna la siguiente información:
Presentación de candidaturas
La presentación de candidaturas deberá realizarse por email a quearte@que.es indicando en el asunto el nombre del artista e incluyendo los datos de contacto hasta el día 08 del mes de mayo de 2022 incluido, fecha en que se cerrará el plazo de inscripción a las 23:59 CET.
Cada participante deberá enviar el siguiente dossier que incluya:
Resumen del curriculum destacando exposiciones realizadas, obras en colecciones de prestigio, becas, premios y residencias
Selección de proyectos y obras anteriormente realizadas, así como textos escritos por críticos o comisarios que avalen su trabajo (si existirá)
Breve memoria conceptual de la obra presentada (no más de 200 palabras).
La ficha técnica completa (título, año, medidas, técnica, peso aproximado, valor aproximado de la Obra (en euros) a efectos del seguro)
Varias imágenes de la pintura presentada: serán necesarias un mínimo de 2 y un máximo de 5 fotografías tomadas desde diferentes perspectivas, teniendo una de ellas que hacer referencia a la escala mostrando una persona junto a la Obra. Cada fotografía será tomada sobre fondo neutro blanco y enviada en formato jpg o png, dimensiones mínimas 800 x 600 px y límite máximo de peso 2M.
De manera opcional, un vídeo de la obra que contemple sus diferentes perspectivas, con una duración máxima de 1 minuto.
Posteriormente el jurado se reunirá y se decidirá qué artista será el ganador y cuáles serán los dos finalistas. Sólo aquellos que hayan sido elegidos se les informará antes de la fecha 30 de junio de 2022.
En ningún momento se enviarán las obras físicamente durante el proceso de selección salvo el ganador y los finalistas una vez comunicados. Recomendamos se realice un dossier completo de no más de 30 páginas que defienda la candidatura.
Es obligatorio cumplimentar toda la información en inglés o en español:
— Nombre del autor, país de participación, fecha y lugar de nacimiento, teléfono de contacto, correo electrónico y dirección postal.
— Copia del pasaporte o de un documento oficial de identidad.
Los participantes deberán velar por la máxima precisión de la información proporcionada ya que, de resultar finalistas, será utilizada en la exposición y el catálogo.
Las candidaturas presentadas a quearte@que.es son confidenciales. Sólo tendrán acceso a ellas el diario, el comité de expertos y el Jurado.
Únicamente se harán públicas las Obras finalistas y la ganadora.
Comité de Expertos
Un Comité de Expertos elegirá entre todas las candidaturas presentadas, entre 15 y 20 obras finalistas (en adelante finalistas) que se someterán a la decisión final del Jurado.

Recepción y devolución de las obras Finalistas
Tras la deliberación del Comité de Expertos que se celebrará el día 1 de junio de 2022, el diario se pondrá en contacto con los autores de las obras que hayan resultado finalistas, a través del teléfono y/o el correo electrónico incluidos en el formulario de inscripción.
Estas obras deberán estar en Madrid entre el 15 y el 30 de septiembre de 2022 ambos inclusive para la entrega de premios y formar parte de la exposición. La fecha de dicho acto se notificará a los interesados en su momento, aunque será en octubre de 2022.
Los autores de las obras finalistas serán los responsables de su correcto embalaje.
El diario se hará cargo del transporte a Madrid y de los gastos incurridos durante el proceso, tales como los aranceles de aduanas, impuestos, seguros, etc.
Las obras finalistas que no puedan viajar a Madrid o que no lleguen a tiempo para la deliberación del jurado podrán quedar automáticamente descalificadas.
La exposición podrá viajar a otras ciudades durante el periodo de licencia (ver derechos de propiedad intelectual).
Al finalizar la exposición, el diario se hará cargo asimismo de la devolución de estas a sus respectivos autores y asumirán los gastos e impuestos incurridos en este proceso, salvo la de la obra ganadora que pasará a ser posesión del Diario.
El diario podría solicitar obras adicionales a los finalistas para incluirlas en la exposición.
La disposición y colocación final de las obras durante la exposición será de competencia exclusiva del diario, reservándose el derecho a no exponer las obras que hayan sufrido algún desperfecto previo aviso a los finalistas.
El diario tomará todas las medidas a su alcance para la mejor conservación y seguridad de las obras durante su exposición, y en caso necesario responderá en lo previsto en el seguro contratado para este período.
Obra ganadora
La deliberación y fallo del Jurado tendrá lugar en el mes de junio de 2022.
Todos los finalistas, en caso de que así se requiera, se comprometen a asistir al acto de entrega de premios y estar disponibles para atender cualquier petición de prensa, asumiendo el diario los gastos de transporte y alojamiento si fueran necesarios.
El ganador, asimismo, estará invitado a formar parte del jurado en la siguiente edición.
El ganador del premio quedará seleccionado por una mayoría absoluta de votos del jurado. Cada uno de los miembros del Jurado cuenta con un voto, si bien el presidente del jurado gozará de un voto de calidad.
La decisión del jurado será definitiva. No se admitirá ninguna clase de impugnación de las decisiones adoptadas. Las deliberaciones del jurado serán confidenciales en todo momento.
El jurado no tendrá la obligación de elegir un ganador del certamen si considera que la calidad de las candidaturas no está a la altura de los criterios cualitativos fundamentales exigidos.
Del mismo modo, el jurado se reserva el derecho a otorgar “Menciones Especiales”, a aquellos candidatos o finalistas que considere oportuno conforme su criterio.
Consideraciones legales
La presentación de una obra a este concurso supone la aceptación íntegra e incondicional de estas bases por parte del participante. El incumplimiento de dichas normas podría constituir un motivo para la descalificación del participante, en cuyo caso u obra será retirada del certamen.
Derechos de propiedad intelectual
El ganador, los finalistas y cualquier participante del certamen manifiestan bajo su responsabilidad el carácter original y no premiado de su obra. Asimismo, manifiestan que no se vulneran ni infringen marcas comerciales, derechos de autor, diseños, modelos, ni ningún otro derecho de propiedad intelectual o industrial, ni otros derechos de terceros, incluidos los derechos de imagen, patronímicos o los derechos sobre voces.
Del mismo modo, el ganador, los finalistas y cualquier participante declaran y garantizan expresamente que la obra presentada al concurso se ajusta plenamente a los requisitos exigidos de conformidad con la legislación vigente en materia de derechos relativos al honor, a la privacidad y la reputación, tanto familiar como personal, a la protección de datos personales, así como a la propiedad intelectual e industrial o a cualesquiera otras disposiciones que pudieren ser aplicables.
El ganador, los finalistas y cualquier participante declaran además que no han transferido, cedido ni conferido la propiedad sobre los derechos de propiedad intelectual, ni tampoco la titularidad/propiedad material sobre la obra con la que se presenta, ni en su totalidad ni en parte, a ningún tercero, desde su creación hasta el final del periodo de licencia.
Los participantes deberán notificar al diario cualquier cambio en la información provista sobre la obra presentada.
El ganador, los finalistas y cualquier participante aceptan y se comprometen a responder ante cualquier reclamación judicial o extrajudicial, así como ante cualquier otra reclamación relativa a los derechos de autor u otros derechos, que pudiere presentarse contra el diario de manera que, en consecuencia, eximen a dichas entidades de cualquier responsabilidad en relación con las disposiciones de las presentes bases.
El ganador y los finalistas se comprometen a concederles automáticamente al diario, tras la revelación por parte del jurado de las obras finalistas, una licencia exclusiva y gratuita de alcance internacional por un periodo de 1 año sobre cualesquiera derechos de propiedad intelectual relativos a su obra (en adelante la Licencia), de cara a la exposición, su preparación y las comunicaciones asociadas a ella, incluido el catálogo, así como de cara a la comunicación del premio y del proyecto relacionado con él, extensivo con carácter general a la totalidad de las actividades del diario. En particular: el derecho a reproducir la obra (incluido el derecho de adaptación) con la ayuda de cualquier método necesario; el derecho a presentar la obra a través de cualquier medio y mediante cualquier método, ya sea conocido o desconocido hasta la fecha; el derecho pleno a la hora de traducir y subtitular la obra hacia cualquier idioma en caso necesario, ya sea en su totalidad o en parte.
De la licencia podrá ser beneficiario el diario y cualquier persona física o jurídica designada por el propio diario, incluidos sus distribuidores, licenciatarios, socios comerciales u otros.
El diario tendrá asimismo autorización para utilizar de forma directa o indirecta, con carácter indefinido e internacional, las obras con los siguientes fines: presentaciones y comunicaciones internas de empresa, información corporativa externa, acciones culturales, formativas, informativas, retrospectivas internas y externas, exposiciones y libros internos y externos, incluidos los correspondientes materiales promocionales.
El diario se reserva el derecho a no utilizar las obras, en su totalidad o en parte. Mientras el periodo de licencia esté en vigor, el diario autoriza al ganador y a los finalistas únicamente a utilizar las obras en sus sitios web personales y en sus redes sociales personales para que les sirvan como referencias profesionales y siempre que el diario ya haya realizado la primera presentación de las Obras. Para cualquier otro uso de las obras, deberá contarse con la autorización previa por escrito del diario.
Se prohíbe además cualquier referencia mutua entre los participantes, el ganador o los finalistas, el diario que pudiere considerarse que daña la imagen o la reputación antes, durante y después de entrar en vigor la licencia.
Todos los participantes reconocen que la participación en el certamen (y en la exposición y la correspondiente comunicación relativa al ganador y a los finalistas) no implica la adquisición de ningún derecho de propiedad intelectual de ninguna naturaleza sobre cualesquiera marcas o creaciones que sean propiedad del diario, incluyéndose, sin limitarse a ello, marcas comerciales, diseños o derechos de autor y que cualquier uso que se haga de dichas marcas o creaciones podría dar lugar a acciones penales o civiles.
Protección de datos personales
En cumplimiento de lo previsto en la Ley Orgánica 15/1999, de 13 de diciembre, de Protección de Datos de Carácter Personal (en adelante, “LOPD”) y el Real Decreto 1720/2007, de 21 de diciembre, por el que se aprueba el Reglamento de desarrollo de la LOPD (en adelante, el “Reglamento”), informamos que los datos personales proporcionados por los concursantes y en su caso, los premiados, para la participación en el concurso, son necesarios y obligatorios para poder gestionar su participación y llegado el caso, la entrega del premio.
Dichos datos serán incorporados a un fichero, cuyo responsable es el diario con domicilio en c/ Apolonio Morales 6, Local J-K 28036 Madrid, España, siendo utilizados con el único objeto de gestionar la participación en el concurso, comunicación y asignación del premio, incluyendo, en su caso, la publicación en las redes sociales y demás canales de comunicación al diario, de cualquier información relativa a los eventos culturales programados por el diario, el control y la gestión de los premios concedidos, el control de los galardonados y de los participantes,así como la comunicación pública de los galardonados con los premios.
Asimismo, mediante la participación en el presente concurso, el participante consiente y acepta que sus datos podrán ser cedidos a la fundación para los fines señalados en la presente cláusula, así como para cualquier otra comunicación de la fundación a los participantes (correos electrónicos, catálogos, eventos, etc.).
Una vez finalizado el concurso, el diario conservará los datos de los participantes y ganadores que hayan dado su consentimiento para que ésta los pueda incorporar en un fichero cuya finalidad será la de informar sobre nuevas promociones y actividades de la Fundación.
Los datos del resto de participantes serán eliminados de los sistemas de tratamiento de datos personales del diario. El tratamiento de datos personales será llevado a cabo de conformidad con el Reglamento General de Protección de Datos del Consejo y de la Comisión de la Unión Europea, 679/2016(RGPD).
Los participantes podrán revocar el consentimiento prestado en cualquier momento, sin necesidad de justificar su decisión, bastando comunicarlo por cualquier medio al diario. En todo caso, queda informado que la revocación de su consentimiento durante el concurso comportará la imposibilidad de seguir participando en el mismo. Asimismo, le informamos que podrá ejercer sus derechos de acceso, rectificación, cancelación, olvido, portabilidad, oposición y/o no tratamiento sistemático para obtención de perfiles mediante la remisión a la dirección postal indicada, de una comunicación escrita, junto con una copia de su documento nacional de identidad o documento acreditativo equivalente, indicando el derecho que desea ejercitar. Por otro lado, los participantes se comprometen a comunicar al diario cualquier modificación de sus datos de carácter personal a fin de que los mismos se encuentren actualizados en todo momento y no contengan errores.
El diario podrá publicar los datos personales del ganador y los finalistas en cualesquiera medios a su disposición, tales como su web www.que.es o las redes sociales a fin de promocionar el premio y garantizar la transparencia.
El diario se compromete a tratar en todo momento sus datos de carácter personal de forma absolutamente confidencial y de acuerdo con las finalidades previstas en la presente cláusula y adoptará las medidas de índole técnica y organizativas necesarias que garanticen la seguridad de sus datos y eviten su alteración, pérdida, tratamiento o acceso no autorizado, habida cuenta del estado de la tecnología, la naturaleza de los datos almacenados y los riesgos a que están expuestos, todo ello en cumplimiento de los dispuesto en el reglamento.
La autoridad de control en protección de datos competente corresponde a Agencia Española de Protección de Datos, c/ Jorge Juan, 6, Madrid, 28001.
La mecánica del concurso exige que los datos sean facilitados de forma veraz y completa, y que sean mantenidos y actualizados gracias a la cooperación de los participantes. Si los datos de carácter personal fueran inciertos, incompletos o no actualizados, el diario quedaría liberado respecto de los casos concretos, del buen fin del concurso y de cualquier consecuencia relacionada con lo anterior, llegando en último caso a la no declaración del ganador del concurso.
Comunicaciones
El ganador y los finalistas están de acuerdo en no realizar comunicados de prensa, ni notas de prensa y cualquier otra comunicación relativa al certamen o la exposición sin la autorización previa por escrito al diario.
El ganador y los finalistas se comprometen a estar disponibles para el diario para la posterior promoción y difusión del premio.
Además, por una parte, el diario y por otra el ganador, los finalistas y cualquier otro participante en el certamen se comprometen a hacer referencia los unos a los otros en términos profesionales y favorables en cualquier comunicado de prensa, nota de prensa u otras comunicaciones.
El diario hará referencia al nombre de los autores en relación con las obras cuando hagan uso de ellas. Tendrán además la libertad de ponerse en contacto con el ganador y los finalistas y de incluirlos en cualquier comunicación, material o medios promocionales con arreglo a los términos de uso especificados en los párrafos anteriores relativos a los Derechos de propiedad intelectual. El diario quedara autorizado, con fines de comunicación, a utilizar el nombre, la biografía y similares detalles del ganador y de los finalistas en cualesquiera medios con arreglo a los términos de uso especificados en los párrafos anteriores relativos a los derechos de propiedad intelectual.
Propiedad material sobre las Obras del Ganador y los Finalistas
La obra ganadora quedará en propiedad del Diario y una vez finalizado el periodo de licencia de un año todas las obras finalistas que decidan vender la sus obras, el diario gozará del derecho de tanteo, específicamente en tanto en cuanto la venta de la obra se le propondrá en primer lugar al diario.
Generalidades
El diario se reserva el derecho a retirar, suspender, ampliar o modificar el certamen y las presentes bases en cualquier momento sin necesidad de notificación previa en caso de que se den circunstancias imprevistas fuera de un control razonable, o bien en casos de fuerza mayor que impidan la materialización de sus previsiones.
No se interpondrán demandas judiciales, extra-judiciales o cualquier otro tipo de alegación por parte de los participantes contra el diario.
Cualquier cambio en las bases será publicado en la web www.que.es.Los participantes tendrán derecho a retirar su candidatura en caso de no aceptar los cambios realizados.
Las bases del certamen se encuentran disponibles en español e inglés. La versión en español será la que prevalezca sobre las demás.
Estas bases y todos los derechos y obligaciones que emanan de ellas se regirán e interpretarán de conformidad con la legislación española. Cualesquiera procedimientos o acciones legales relacionadas con estas bases y, de forma general, con el premio deberán someterse expresamente a la jurisdicción de los Juzgados y Tribunales de Madrid, España.
BASES PAINTING AWARD DAILY QUÉ!
QUÉ! ART
Qué! is a generalist Spanish newspaper. It was founded in 2005. It currently belongs to the Merca2 Group, which also includes other online media such as Merca2.es, Moncloa.com and Cotilleo.es.
“The newspaper Qué! (hereinafter the newspaper) with a fundamental objective in information and current affairs, develops the Painting Prize «Qué! Art» whose purpose is to support and promote young international painters whose language is close to figuration, more specifically their pop or street art side that provokes a reflection on today’s society.
Objetives
The objective of this award is to disseminate, promote, or publicize the work of painters. The newspaper seeks to reward works with artistic ambition and innovative will that reflect the personal language of an author. The diary seeks to be a patron of both national and international creators whose language is figurative with critical content capable of producing paintings that aspire to create memory and reflection.
Prize
The prize money is six thousand euros (6,000 euros) for the winning painting plus a report that would promote the artist in the newspaper, with more than 3,000,000 monthly readers. ato).
The second and third classified will have two reports on the author and his work in the newspaper in the following years, 2022 and 2023. With this, the follow-up of its authors and the dissemination of his work are sought.
The prize will have the withholding of the corresponding Personal Income Tax (IRPF), in accordance with current legislation in Spain, if applicable.
Participation Requirements
Individually, any artist with a degree in Fine Arts, Architecture or similar, over 18 years of age at the time the registration is sent, and of any nationality, may participate.
The technique will be painting on any support. The language will be figurative, close to the currents of pop art or street art with critical content.
The submitted painting must be original and unpublished and not be pending voting or have been awarded in any other contest or competition.
Each participant may submit only one work that makes up a single artistic creation (hereinafter, the work).
Works with violent, sexist, irreverent, obscene, xenophobic, anti-constitutional or any other content likely to violate the dignity of people or Human Rights will not be accepted.
Works that, although they cannot be classified in the listed categories, can be accepted by the committee of experts as long as they meet the objectives and requirements of the contest will not be ruled out.
The winning Painting must be:
Property of the participant, at all times, from its creation until the end of the license period,
An original and unique piece.
Of current creation (last five years),
Not previously awarded, and not be pending voting or have been awarded in any other contest or contest.
Transportable and installable.
These conditions are essential for the works to be admitted as finalists.
Each author may participate only with one work, individually.
Participation will be ruled out in the following cases:
• If the participant submits the work to another contest and obtains a prize,
• if the Work ceases to be in your possession
• if, for whatever reason, it becomes the property of a third party,
• If the Work is damaged once it has been presented, you must notify the newspaper urgently by email in order to withdraw it from the contest. Once the work has been submitted to the contest, it cannot be altered in any way.
If any violation of the admission requirements is detected, the participant could be disqualified and his candidacy not be considered.

Presentation of applications
The presentation of candidacies must be made by email to quearte@que.es indicating the name of the artist in the subject and including the contact information until April 08, 2022 included, the date on which the registration period will close. at 23:59 CET.
Each participant must send the following dossier that includes:

Several images of the presented painting: a minimum of 2 and a maximum of 5 photographs taken from different perspectives will be necessary, one of them having to refer to the scale showing a person next to the Work. Each photograph will be taken on a neutral white background and sent in jpg or png format, with a minimum size of 800 x 600 px and a maximum weight limit of 2Mb.
Optionally, a video of the work that contemplates its different perspectives, with a maximum duration of 1 minute.
Later the jury will meet and decide which artist will be the winner and which will be the two finalists. Only those who have been chosen will be informed before the date June 30, 2022.
At no time will the works be physically sent during the selection process, except for the winner and the finalists once they have been announced. We recommend creating a complete dossier of no more than 30 pages that defends the candidacy.
It is mandatory to fill in all the information in English or Spanish:
— Author’s name, country of participation, date and place of birth, contact telephone number, email and postal address.
— Copy of passport or official identity document.
Participants must ensure the maximum precision of the information provided since, if they are finalists, it will be used in the exhibition and the catalogue.
Applications submitted to quearte@que.es are confidential. Only the newspaper, the committee of experts and the Jury will have access to them.

Committee of Experts
A Committee of Experts will choose between 15 and 20 finalist works (hereinafter finalists) among all the submitted applications, which will be submitted to the final decision of the Jury.
The Committee of Experts will be composed in this edition by:

Reception and return of the Finalist works
After the deliberation of the Committee of Experts that will be held on June 1, 2022, the newspaper will contact the authors of the works that have been finalists, through the telephone and/or email included in the registration form. .
These works must be in Madrid between September 15 and 30, 2022, both inclusive, for the award ceremony and to be part of the exhibition. The date of said act will be notified to the interested parties at the time, although it will be in October 2022.
The authors of the finalist works will be responsible for their correct packaging. The newspaper will take care of the transport to Madrid and the expenses incurred during the process, such as customs duties, taxes, insurance, etc.
The finalist works that cannot travel to Madrid or that do not arrive in time for the deliberation of the jury may be automatically disqualified.
The exhibition may travel to other cities during the license period (see intellectual property rights).
At the end of the exhibition, the newspaper will also be responsible for the return of these to their respective authors and will assume the expenses and taxes incurred in this process, except for the winning work that will become the possession of the newspaper.
The newspaper may request additional works from the finalists to include them in the exhibition.
The layout and final placement of the works during the exhibition will be the exclusive responsibility of the newspaper, reserving the right not to exhibit the works that have suffered any damage prior notice to the finalists.
The newspaper will take all the measures at its disposal for the best conservation and safety of the works during their exhibition, and if necessary, it will respond as provided in the insurance contracted for this period.
Winning work
The deliberation and decision of the Jury will take place in June 2022.
All finalists, if required, agree to attend the awards ceremony and be available to attend to any press requests, with the newspaper assuming transportation and accommodation costs if necessary.
The winner will also be invited to be part of the jury in the next edition.
The winner of the award will be selected by an absolute majority of votes of the jury. Each of the members of the Jury has one vote, although the president of the jury will have a casting vote.
The decision of the jury will be final. No objection of any kind to the adopted decisions will be accepted. The deliberations of the jury will be confidential at all times.
The jury will not have the obligation to choose a winner of the contest if it considers that the quality of the applications is not up to the fundamental qualitative criteria required.
In the same way, the jury reserves the right to award «Special Mentions» to those candidates or finalists that it deems appropriate according to its criteria.
Legal considerations
The presentation of a work to this contest implies the full and unconditional acceptance of these rules by the participant. Failure to comply with these rules could constitute a reason for the disqualification of the participant, in which case or work will be withdrawn from the contest.
Intellectual Property Rights
The winner, the finalists and any participant in the contest declare under their responsibility the original and non-awarded nature of their work. Likewise, they state that they do not violate or infringe trademarks, copyrights, designs, models, or any other intellectual or industrial property rights, or other rights of third parties, including image rights, patronymics or the rights
about voices.
In the same way, the winner, the finalists and any participant expressly declare and guarantee that the work submitted to the contest fully complies with the requirements demanded in accordance with current legislation on rights related to honor, privacy and reputation. , both family and personal, to the protection of personal data, as well as intellectual and industrial property or any other provisions that may be applicable.
The winner, the finalists and any participant further declare that they have not transferred, assigned or conferred the ownership of the intellectual property rights, nor the title/material ownership of the work with which it is presented, neither in whole nor in part. , to any third party, from its creation until the end of the license period.
Participants must notify the newspaper of any change in the information provided about the work presented.
The winner, the finalists and any participant accept and undertake to respond to any judicial or extrajudicial claim, as well as any other claim related to copyright or other rights, that may be filed against the newspaper so that, consequently, exempt said entities from any liability in relation to the provisions of these rules.
The winner and the finalists agree to automatically grant aldiario, after the jury reveals the finalist works, an exclusive and free international license for a period of 1 year on any intellectual property rights related to their work (in hereinafter the License), with a view to the exhibition, its preparation and the communications associated with it, including the catalogue, as well as with regard to the communication of the award and the project related to it, extensive in general to all the activities From the newspaper. In particular: the right to reproduce the work (including the right of adaptation) with the help of any necessary method; the right to present the work through any media and by any method, whether known or unknown to date; the full right to translate and subtitle the work into any language if necessary, either in whole or in part.
The newspaper and any natural or legal person designated by the newspaper itself, including its distributors, licensees, business partners or others, may be the beneficiary of the license.
The newspaper will also be authorized to use the works directly or indirectly, on an indefinite and international basis, for the following purposes: internal company presentations and communications, external corporate information, cultural, training, informative actions, internal and external retrospectives, exhibitions and internal and external books, including the corresponding promotional materials.
The newspaper reserves the right not to use the works, in whole or in part.
While the license period is in force, the newspaper authorizes the winner and the finalists only to use the works on their personal websites and personal social networks to serve as professional references and provided that the newspaper has already made the first Presentation of the Works. For any other use of the works, you must have the prior written authorization of the newspaper
Any mutual reference between the participants, the winner or the finalists, the newspaper that could be considered to damage the image or reputation before, during and after the license comes into force is also prohibited.
All participants acknowledge that participation in the contest (and in the exhibition and the corresponding communication regarding the winner and the finalists) does not imply the acquisition of any intellectual property rights of any nature over any brands or creations owned by the newspaper, including, but not limited to, trademarks, designs, or copyrights, and that any use of such trademarks or creations may result in criminal or civil action.
Personal data protection

Material ownership of the Works of the Winner and the Finalists
The winning work will remain the property of the newspaper and once the one-year license period has ended, all the finalist works that decide to sell their works, the newspaper will enjoy the right of first refusal, specifically insofar as the sale of the work is will first propose to the newspaper.
Generalities
The newspaper reserves the right to withdraw, suspend, extend or modify the contest and these rules at any time without the need for prior notification in the event of unforeseen circumstances beyond reasonable control, or in cases of force majeure that prevent the materialization of their forecasts.
No judicial, extra-judicial lawsuits or any other type of allegation will be filed by the participants against the newspaper.
Any change in the bases will be published on the website www.que.es. Participants will have the right to withdraw their candidacy if they do not accept the changes made.
The bases of the contest are available in Spanish and English. The Spanish version will be the one that prevails over the others.
These bases and all the rights and obligations that emanate from them will be governed and interpreted in accordance with Spanish legislation. Any procedures or legal actions related to these rules and, in general, to the prize must be expressly submitted to the jurisdiction of the Courts and Tribunals of Madrid, Spain.
