PhMuseum 2023 Photography Grant Terms and Conditions Welcome to the PhMuseum 2023 Photography Grant Terms! This document defines the Terms and Conditions (Terms) that govern your use of the PhMuseum 2023 Photography Grant (2023 Grant or Grant) webpages. These Terms apply between You (You or Entrant), and PHmuseum Srl (PhMuseum or We), the Italy-based corporation with a registered office at Via Paolo Fabbri 10/2a, 40138, Bologna, Italy, Company Number IT03908051208, owning and operating the phmuseum.com website, all the related websites and services and the Photographic Museum of Humanity and PhMuseum trademarks. By ticking the Terms and Conditions box, clicking the Pay and Submit button in the last step of the Grant submission process and completing the entry fee payment, You participate in the 2023 Grant and You hereby acknowledge and agree to be bound by these Terms and Conditions. Please read them carefully before applying to the 2023 Grant. 1. Grant rules The PhMuseum 2023 Photography Grant begins on 11 January 2023 at 12:01 am Greenwich Mean Time (GMT) and ends on 16 February 2023 at 11:59 pm (GMT). Entrants can participate by clicking on the Apply Now button available at phmuseum.com/grants/2023-photography-grant and following the guided submission process. Entrants must be at least 18 years old as of the date of entry. Collaborative projects are accepted. Each Entrant can submit one or more “Project”, defined as a set of photos built around a concept or a topic. Each Project must feature a minimum of 5 photos and a maximum of 20 photos that will be taken under consideration by the 2023 Grant Judges. Photos shall be uploaded in Jpg or Jpeg format and each individual photo cannot weigh more than 10 Megabytes. To complete the submission of a Project, the Entrant shall pay the entry fee displayed on the 2023 Grant landing page. A reduced entry fee applies for Projects submitted before the Early Bird Deadline set on 26 January 2023 at 11:59 pm (GMT). Entrants who apply before the Early Bird Deadline, can edit their application until 72 hours after the Early Bird Deadline. Entrants who apply after the Early Bird Deadline have time until the Final Deadline to edit their submission from the My Submissions page. Winners will be announced on phmuseum.com/grants/2023-photography-grant within 120 days of the deadline or extended deadline day. By accepting these Terms You agree and accept that the decisions of the Judges are final on all matters relating to the PhMuseum 2023 Photography Grant. The PhMuseum 2023 Photography Grant is void where prohibited. 2. Prizes & Judges The PhMuseum 2023 Photography Grant will offer the following prizes: a) PhMuseum 2023 Grant 1st prize: EURO 5,000 plus promotion via PhMuseum; b) PhMuseum 2023 Grant 2nd prize: EURO 2,000 promotion via PhMuseum; c) PhMuseum 2023 Grant 3rd prize: EURO 1,000 promotion via PhMuseum; d) PhMuseum 2023 Grant New Generation prize: EURO 2,000 promotion via PhMuseum; e) Up to 6 Main Prize Honorable Mentions f) Up to 3 New Generation Prize Honorable Mentions g) A solo exhibition at PhEST 2023; h) A solo exhibition at Getxophoto 2023; i) A residency at Landskrona Foto in 2023; j) A solo exhibition at Fonderia 20.9 in 2023; k) 6 Free Online Portfolio Reviews from PhMuseum Education; l) Projection at Verzasca Photo 2023, Jakarta International Photo Festival 2023, PhMuseum Days 2023; Prizes at points (a), (b), (c), (d), (e), (f) and (l) will be assigned by the independedt jury. Prize at point (g) will be assigned by PhEST Team. Prize at point (h) will be assigned by Maria Ptqk, Getxophoto Artistic Director. Prize at point (i) will be assigned by Landskrona Foto's Director Jenny Nordquist. Prize at point (j) will be assigned by Fonderia 20.9 Team. Prize at point (k), will be assigned by Giuseppe Oliverio and Rocco Venezia from PhMuseum. Photographers who are 30 (thirty) years of age, or less, on the day of the PhMuseum 2023 Photography Grant final deadline are the only applicants eligible for prizes at points (d). Each 2023 Grant participants will also benefit from a 10% discount on all the online one-to-one classes available at phmuseum.com/education purchased before 30 March 2023. Cash Prizes are paid in EURO, yet you can see an approximated equivalent in USD or GDP, according to the preferred currency you select. 3. Candidates undertakings By ticking the Terms and Conditions box, clicking the Pay and Submit button in the last step of the Grant submission process and completing the entry fee payment, You participate in the PhMuseum 2023 Photography Grant and You hereby acknowledge and agree to be bound by these Terms and Conditions. By doing so, You also acknowledge and agree that You will not be able to: a) delete or edit any photos of the submitted Project from the PhMuseum website nor alter their order; b) delete or edit any information to the submitted Project from the PhMuseum website from the day You submit the Project to 120 days after the PhMuseum 2023 Photography Grant deadline or extended deadline. By accepting these Terms and entering the PhMuseum 2023 Photography Grant You warrant that all the information submitted is true, current, and complete. You also warrant that You have all the necessary consents in relation to your entry and that You are the copyright owner of any copyright works submitted, e.g. photographs, texts, drawings, and PhMuseum's use of such works will be at no charge, will not infringe the rights of any third party, and You will fully indemnify PhMuseum in the event of any infringement. You also acknowledge that the full names of the winners may be published by PhMuseum, and You grant to PhMuseum a non-exclusive perpetual, worldwide royalty free license to use and publish your entries in whole or in part in any media form whatsoever, for the sole purposes of the current and future Grant’s editions promotion. If the photographs contain any material or elements that are not owned by the Entrant and/or that are subject to the rights of third parties, and/or if any persons appear in the photograph, the Entrant is responsible for obtaining, prior to submission of the photograph, any and all releases and consents necessary to permit the publication, exhibition and use of the photograph in the manner set forth in these Terms without additional compensation. If any person appearing in any photograph is under the age of majority in their state/province/territory of residence the signature of a parent or legal guardian is required on each release. 4. PhMuseum undertakings PhMuseum commits to credit the due amount to the cash prize winners within 120 days of the winners announcement, provided that the winner communicates via email to PhMuseum (i) valid and complete bank account details and (ii) a copy of a valid ID within 30 days after the winners announcement. PhMuseum will notify each prize winner at the email address associated to the respective winners’ PhMuseum accounts within 30 days after the results announcement. The winner will have 15 days from the day he or she will be notified to answer PhMuseum and claim the prize. If PhMuseum is unable to notify the winner, or if the winner fails to respond within the fixed time period as specified, this may result in forfeiture of the prize and PhMuseum reserves the right to select an alternative winner in accordance with these Terms and the Grant information. PhMuseum may in its sole discretion refuse to provide a prize, or seek its recovery, in the event of non-entitlement under these Terms or an Entrant's breach of these terms and conditions, PhMuseum’s website terms of use, fraud, dishonesty, or other inappropriate or improper conduct including but not limited to the use of technology which enables an Entrant to evade charges or entry requirements. PhMuseum commits to always mention the author copyrights. When You submit photographs to the PhMuseum website, You remain the copyright owner of the photographs You submit to the PhMuseum website and PhMuseum does not claim ownership over the photographs. Licences/releases By ticking the Terms and Conditions box, clicking the Pay and Submit button in the last step of the Grant submission process and completing the entry fee payment, You submit Your Project to the PhMuseum 2023 Photography Grant and You make the following representations and warranties: a) You can lawfully enter into contracts under applicable law and You are at least 18 years old; b) You have obtained and have copies of model releases from all subjects depicted in the photograph(s) You submit to the PhMuseum 2023 Photography Grant, and such persons voluntarily consented to publication and/or dissemination of their likeness for all legal purposes. Neither PhMuseum nor their associates, affiliates or partners assume any responsibility for photos submitted in violation of these Terms. Images that demonstrate violations on copyright and/or Grant policies will be removed & disqualified by PhMuseum after due investigations. 6. Limitation of liability By participating, Entrants agree to release, discharge, and hold harmless PhMuseum and each of their respective partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in the PhMuseum 2023 Photography Grant-related activities. PhMuseum assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorised access to Grant entries or entry forms; or alteration of entries or entry forms. PhMuseum is not responsible for any issue with or technical malfunction of any online computer systems, servers or providers, computer equipment, software, failure of any email entry to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof, including any damage to Entrants’ or any other persons’ computers related to or resulting from participation, uploading, or downloading of any materials related to this Grant. Neither PhMuseum nor its servants, agents, nor any other party or organization involved in the management, promotion, or administration of the Grant or its entry routes or donation of prizes or their agents or subsidiaries involved in the Grant will accept responsibility or liability for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of network availability, server functions (including but not limited to security functions by software used by PhMuseum or any third party), virus, malware, trojans, bugs, or other causes outside its control. 7. Dispute and claims You acknowledge and agree that these PhMuseum 2023 Photography Grant Terms together with the PhMuseum Privacy Policy, as well as any claim that might arise between You and PhMuseum, shall be governed and interpreted according exclusively to the law of Italy. You further acknowledge and agree that the courts of Bologna, Italy shall be the exclusive forum where You agree to resolve any claim, cause of action or dispute between You and PhMuseum arising out of or relating to these Terms. 8. Right to cancel or suspend grant If for any reason the Grant is not capable of running as planned for bugs, worms, trojan horses, denial of service attacks, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of PhMuseum that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Grant, PhMuseum reserve the right, at their sole discretion, to cancel, terminate, modify, or suspend the Grant. PhMuseum cannot promise that the services relating to the Grant will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond the control of PhMuseum. PhMuseum will not be liable in the event that all or any part of the service relating to the Grant is discontinued, modified or changed in any way. 9. Privacy Please see our Privacy Policy.
